According to the US Attorney for the Southern District of New York, 26-year-old Adam Vitale and his co-defendant Todd Moeller were caught out after having entered into an agreement with a government confidential informant to send spam in exchange for half of the profits that resulted from the spamming.

The pair sent over 1.2 million messages to AOL customers over the course of two days in August 2005.

Vitale, who will be sentenced in September, faces a maximum sentence of 11 years in prison and a fine of $250,000, or double the maximum gain or loss resulting from the offence. Moeller's case is still pending.

The New York Post reports on the case here.
